1. Parties & Acceptance
These Terms & Conditions are an agreement between <ENTITY_TBD> ("FalconProxy", "we", or "us") and the person or legal entity that creates an account ("you" or the "Customer"). By creating an account, registering a device, or routing traffic through our infrastructure, you agree to these Terms. If you do not agree, you must stop using the service. You must be at least 16 years old to use FalconProxy.
2. What FalconProxy Provides
FalconProxy provides technology, not bandwidth. The service consists of (a) relay servers we operate, (b) the dashboard webapp at falconproxy.com, and (c) the FalconProxy Android app, which you install on your own Android device(s) to expose your own mobile or residential connection as a SOCKS5 / HTTPS-CONNECT proxy reachable through the relay.
All egress traffic exits your own device, over your own carrier or ISP. We are not a reseller of residential or mobile bandwidth. We do not have visibility into the content of your proxied requests — the relay sees only destination IP/port and byte counts at the connection layer.
You may use FalconProxy as the device operator, as the proxy consumer, or both. There is no third-party device-operator marketplace. You are the sole party responsible for the device, the SIM, the connection, and every request that egresses through it.
3. Your Account
You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. We will treat anyone authenticating with your credentials as you. Notify us promptly at contact@falconproxy.com of any suspected unauthorized use.
4. Your Responsibilities
You agree to:
- Use the service only as permitted by these Terms and our Acceptable Use Policy, which is incorporated by reference.
- Comply with all applicable law in (a) your jurisdiction of residence, (b) the jurisdiction of the device's network egress, and (c) the jurisdiction of every traffic destination.
- Maintain ownership or authorized control over every device you register.
- Obtain any consent required from third parties whose data or services you access via proxied traffic.
- Not abuse the service. The list of prohibited uses appears in the Acceptable Use Policy and includes (without limitation) CSAM, malware C2, credential stuffing, spam, fraud, DDoS, scraping in violation of a target's terms, and sanctions evasion.
5. Payment & Billing
Subscriptions are per-device-slot, billed monthly or annually via Stripe. You authorize us (and Stripe acting as our payment processor) to charge the payment method on file for subscription fees, slot increases, and applicable taxes. New accounts may use a two-hour trial with one device slot before subscribing.
Slot increases take effect immediately and are prorated against the current billing period. Slot decreases and plan downgrades take effect at the next renewal; current capacity is preserved until then. Failure to pay may result in suspension after a reasonable grace window.
6. Refunds & Cancellation
Subscriptions are non-refundable mid-cycle. You may cancel at any time; cancellation takes effect at the end of the current billing period and the service remains available until then. We may, in our sole discretion, issue good-faith refunds for documented service incidents that materially deprived you of access for a substantial portion of a billing period. No refunds are issued for slot decreases, mid-cycle downgrades, or service suspended due to AUP violation.
7. Termination
By you for convenience. You may close your account at any time via the dashboard. The account becomes inactive at the end of the current billing period.
By us for convenience. We may terminate or refuse service for any lawful reason with at least 14 days' written notice, prorating any unused prepaid period as a refund.
For cause or AUP violation. We may suspend or terminate immediately, without refund, if we determine in good faith that you have violated these Terms, the AUP, or applicable law, or if continued service would expose FalconProxy or third parties to legal, regulatory, or reputational risk. 8. Indemnification
You agree to defend, indemnify, and hold harmless FalconProxy, its affiliates, and their respective officers, directors, employees, and agents from and against any claim, demand, loss, damage, liability, fine, penalty, or expense (including reasonable attorneys' fees) arising out of or related to (a) traffic you originate or route through the service, (b) your breach of these Terms, the AUP, or applicable law, (c) your infringement of any third-party right, or (d) any action a third party takes against us because of your use of the service.
9. Disclaimers
The service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We do not warrant any specific throughput, latency, geographic IP availability, or third-party site reachability. Mobile and residential proxy behavior depends on your device, SIM, carrier, and the policies of destination services — none of which we control.
10. Limitation of Liability
To the maximum extent permitted by law, our total cumulative liability arising out of or related to the service or these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim. In no event shall we be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, even if advised of the possibility of such damages.
11. Governing Law & Venue
These Terms are governed by the laws of <ENTITY_TBD>'s jurisdiction of incorporation, without regard to its conflict-of-laws principles. The parties consent to the exclusive jurisdiction of the courts located in that jurisdiction for any dispute arising out of or related to these Terms, except that either party may seek injunctive relief in any court of competent jurisdiction.
12. Sanctions & Export
You represent and warrant that you are not located in, organized under, or a resident of any country or region subject to comprehensive sanctions (including Cuba, Iran, North Korea, Syria, the Crimea / Donetsk / Luhansk regions of Ukraine, and Russia where applicable), and that you do not appear on any restricted-party list. You may not route traffic into or out of those jurisdictions or to or from sanctioned persons.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified to the email address on file at least 30 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms. If you do not accept the changes, you must cancel before the effective date.
